Willemstad/Philipsburg – Hushang Ansary knows no stopping. Despite his resignation as director of SunResorts Ltd. (Mullet Bay) Ennia’s most important asset – he still pretends it’s his own and he has everything to say about it.

This is harmful to SunResorts and therefore also harmful to Ennia, which Ansary and his associates are struggling with a solvency deficit, partly as a result of large-scale withdrawals from the Curacao insurance business, for which he and other former directors of Ennia were already ordered to pay more than a billion dollars in compensation.

SunResorts) have filed summary proceedings against Ansary in Houston, Ralph Palm in Curacao and Clarence Derby in Sint Maarten with the aim of an
’emergency provision’ from the court of Sint Maarten. Necessary to counter opposing them and causing further damage.

Ennia is seen by the Central Bank of Curacao and Sint Maarten (CBCS) as a systemically important insurance company, which was acquired in 2006 by
Parman International from the Iranian
American Ansary. According to the CBCS, Ennia has run into financial problems in recent years due to Ansary’s actions, so that the emergency regulation had to be applied in 2018.
Mullet Bay – a large plot of land with a golf course plus beach on Sint Maarten, housed in SunResorts – is of crucial importance to Ennia. Instead of capital in cash,
SunResorts was contributed by Ansary.

However, the value for which it was included on the Ennia balance sheet continued to increase and at one point even amounted to more than $430 million. On paper. The main part of Ennia’s assets.

But after appraisals commissioned by the CBCS, the real value turned out to be much less, with all the financial consequences for Ennia. Ansary and other former directors were held liable and ordered by the Curacao court at the end of 2021 to pay more than a billion in damages.

As this newspaper reported earlier, ECI — which owns 93 percent of SunResorts’ stock and is controlled by the Central Bank in connection with the emergency regulation — fired Ansary at a shareholders’ meeting on Aug. 1, and appointed two new directors in his place: a former civil-law notary. Mike Alexander and Chartered Accountant Geomaly Martes. To put things in order in the interest of Ennia policyholders.

Sowing confusion, Ansary has apparently called a SunResorts shareholders’ meeting and named herself, Palm and Derby as directors. Suddenly they claim that EC Investments is not (any longer) the owner of SunResorts (Mullet Bay), although this is

stated in all (annual) documents drawn up and signed by them.
The CBCS asks the judge to stop Ansary’s abusive and harmful behavior, also because SunResorts/Mullet Bay is the main asset of Ennia, which has thousands of policyholders.
The parties make no announcements about this delicate matter, which is of great importance to Ennia (and therefore mainly Curacao) and also to Sint Maarten, which for years – since Hurricane Luis in 1995 has had to see to it that virtually nothing happens with one of the few remaining sites on the island intended for tourist development.
The judge in Philipsburg is expected to make a decision soon.
